Terms and Conditions for Holiday Packages Consumers
These Terms and Conditions apply to multi-day travel packages, excursions, tours, and related services organized and sold by All Seasons Lapland Oy (hereinafter "All Seasons Lapland", "we", "us", or "the Organizer") to consumer customers.
These terms comply with the Finnish Package Travel Act (901/2017) and Directive (EU) 2015/2302 on package travel and linked travel arrangements.
1. Conclusion of the Contract and Payment Terms
• Binding Agreement: A binding contract is formed once the customer books a service via our website, email, or booking system, and the Organizer confirms the booking in writing.
• Deposit: To secure the booking, the customer must pay a 20% deposit of the total price within 7 days of receiving the booking confirmation.
• Final Payment: The remaining balance (80%) must be paid no later than 21 days before the departure date.
• Late Payments: Failure to pay the deposit or the final balance by the due date entitles the Organizer to cancel the booking unilaterally.
2. Cancellation by the Customer
If the customer cancels the trip or excursion, All Seasons Lapland will charge cancellation fees based on the notice given before the scheduled start date:
• More than 60 days prior to departure: Cancellation is free of charge, except for an administrative fee of €50 per booking.
• 30 to 60 days prior to departure: The paid 20% deposit is non-refundable.
• 15 to 29 days prior to departure: A cancellation fee of 50% of the total package price will be charged.
• 14 days or less prior to departure: A cancellation fee of 100% of the total package price will be charged (no refund).
3. Cancellation and Alterations by the Organizer
• Force Majeure: The Organizer reserves the right to cancel a tour or alter the itinerary due to unavoidable and extraordinary circumstances (e.g., extreme weather conditions, natural disasters, safety risks).
• Minimum Number of Participants: If a tour requires a minimum number of participants and it is not reached, the Organizer can cancel the tour by notifying the customer at least 14 days before the scheduled departure.
• Refunds: If the Organizer cancels the trip, all payments made by the customer will be refunded in full. The Organizer is not liable for any additional expenses incurred by the customer (such as independently purchased flight tickets).
4. Special Arctic Conditions, Safety, and Customer Conduct
• Weather Adjustments: Weather conditions in Lapland can change rapidly. For safety reasons, the Organizer reserves the right to change tour routes, timetables, duration, or activities.
• Safety Instructions: Customers must strictly follow all safety regulations and driving instructions given by the guides. The guide has the right to terminate a customer's participation if they endanger themselves, other participants, or animals.
• Alcohol and Substance Policy: Operating motorized vehicles under the influence of alcohol or other intoxicants is strictly prohibited (0.0‰ zero-tolerance policy).
• Child Passengers on Safaris: Children traveling on snowmobile safaris are seated in a safe sled pulled by the guide's snowmobile. To sit directly on the snowmobile as a passenger behind an adult, a child must be at least 135 cm tall.
5. Children, Age Restrictions, and Discounts
• Minimum Age for Drivers: To drive a snowmobile, the driver must be at least 18 years old and hold a valid driving license.
• Child Discounts: Reduced child rates apply to children and youths aged 4 to 17 years old.
• Infants: Children under 4 years old may participate in specific suitable tours, but please contact us in advance to ensure safety and equipment availability.
• Parental Responsibility: Parents or legal guardians are fully responsible for the safety, behavior, and supervision of their children at all times during all tours and activities.
6. Driver's Self-Liability (Deductible) in Case of Damage
• Self-Liability: All snowmobile safaris include statutory traffic insurance. However, if a customer causes damage to the vehicle, safari equipment, or a third party due to their driving or negligence, they are liable to pay for damages up to a maximum self-liability amount of €1000 per accident.
• Intentional Damage: The self-liability limit does not apply if the damage is caused intentionally, through gross negligence, or while driving under the influence of alcohol or drugs. In such cases, the customer is fully liable for the total cost of all damages.
7. Insurance and Travel Documents
• Travel Insurance: All Seasons Lapland strongly advises all customers to purchase comprehensive travel insurance. The insurance policy should cover cancellation costs, medical expenses, and specific Arctic winter sports or adventure activities.
• Passports, Visas, and Driving Licenses: The customer is solely responsible for holding a valid passport, visa, and any required health certificates. To drive a snowmobile, drivers must hold and carry a valid driving license (at least class T, B, or equivalent international license).
8. Defects and Complaints
• Immediate Notification: If the customer notices any defect or error during the trip or excursion, it must be reported immediately on-site to the local guide or customer service. This allows the Organizer the opportunity to rectify the issue immediately.
• Compensation Claims: If a defect cannot be resolved on-site and it significantly reduces the value of the service, a written claim for compensation must be submitted to the Organizer no later than 30 days after the end of the trip.
9. Applicable Law and Disputes
• Jurisdiction: These terms and conditions are governed by and construed in accordance with Finnish law.
• Dispute Resolution: Any disputes shall be resolved primarily through negotiation. If a mutual agreement cannot be reached, a consumer customer has the right to submit the matter to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta).
